This application for anticipatory bail arises out of Ghorasahan P.S. Case No. 206 of 2019 for the offence punishable under Sections 341, 323, 324, 324, 354, 379, 307 and 427/34 of the Indian Penal Code.
There is allegation in the First Information Report that the named accused persons made an assault on the informant and his family members.
Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.57554 of 2019(2) dt.13-09-2019 2/3 petitioners has submitted that though there is specific allegation against petitioner No.1, Manoj Singh, of having assaulted father of the informant with an iron rod, but the injury has been found to be simple in nature. She has submitted that all the family members, including female members, have been implicated in the criminal case and there is a counter case also for the same occurrence. According to her, the injuries, said to have been caused by the petitioners, have been found to be simple in nature. She has also argued that the petitioners and the informant are agnates.
Considering the above, this application is allowed. Let the petitioners above named, in the event of their arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Sikrahana at Dhaka, East Champaran, in Ghorasahan P.S. Case No. 206 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their
