JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 29-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be main assailant and it is informed on behalf of the petitioner that except I.O. and two prosecution witnesses, all the prosecution witnesses have already been examined and all the aforesaid prosecution witnesses have turned hostile.

It appears that the trial of the petitioner is going on in full swing.

Accordingly, taking note of allegation as well as stage of the trial, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Session trial no. 160 of 2013, arising out of Tariyani P.S.Case No. 96 of 2013, pending in the court of Additional Sessions Judge-I, Sheohar,

Patna High Court Cr.Misc. No.8579 of 2017 (2) dt.29-03-2017 2/2 stands rejected.
