Learned counsel for the State has filed a counter affidavit stating therein that the petitioner has filed a Title Suit No. 18 of 2023 in the Court of Sub-Judge 1, Udakishunganj for the same set of land and for correction of R.S. Khatiyan and it appears from the pleadings of the writ petition, the writ petition has also been filed for the same relief.

3. After some arguments, learned counsel for the petitionier seeks permission to withdraw the application with liberty to pursue the matter in Title Suit No. 18 of 2023 which is pending before the competent court of law.
4. Permission is accorded.
5. With the aforesaid liberty, the writ petition stands dismissed as withdrawn.
