JUSTICE ASHUTOSH KUMAR ORAL ORDER 28.08.2020 This is an application seeking quashing of the F.I.R. bearing Sugauli P. S. Case No. 148 of 2015 dated 05.05.2015 instituted for the offences under Sections 420, 467, 468, 471, 120 (B), 147, 148, 149 and 506 of the Indian Penal Code.
This case was heard for the first time on 28.03.2018 when notice was issued to Opposite Party
No. 2 and the case was directed to be listed immediately on receipt of the same.
It appears that the investigation began in the year 2015. In the absence of any information regarding the stage of investigation, this Court presumes that the investigation must have been completed by now as five years have passed by.
In any view of the matter, if the investigation has not been completed, the same shall be completed within a period of three months from the date of receipt/production of a copy of this order.
In case the petitioners feel aggrieved by the aforesaid report, they will have the liberty to take recourse of the legal remedies available to them. The petition stands disposed off accordingly. (Ashutosh Kumar, J) skm U T
