1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of anticipatory bail apprehending his arrest in connection with Bhadaur P.S. Case no.46 of 2025, registered under sections 109(1), 190, 191(2), 191(3), 126(2) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 and section 27 of the Arms Act.

As per the prosecution case, it is stated that six named accused persons including the petitioner herein over a dispute pertaining to immovable property surrounded the informant and the elder brother of her husband. Co-accused Santu Yadav fired upon the elder brother of the husband of the informant, however he was somehow saved.

4. Learned counsel for the petitioner submits that

Accepting the allegations levelled in the F.I.R., there is no specific overt act against this petitioner. The main allegation is against co-accused Santu Yadav. The petitioner undertakes to cooperate in the investigation/trial.

5. The application for anticipatory bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R., the main allegation being against co-accused Santu Yadav and not the petitioner herein, in the facts of the case it is directed that the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of four weeks, be released on anticipatory bail in connection with Bhadaur P.S. Case no.46 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate Ist Class, Barh, Patna.
