JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-09-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

The prosecution case is that the dead body of younger brother of the informant Aano Yadav and uncle Mahadeo Yadav were found on the road, leading to registration of FIR against unknown. During investigation, the suspicion was raised against the petitioner and others on the basis of information supplied by the police spy.

It is submitted by learned counsel for the petitioner that other co-accused Manoj Yadav, whose name also transpired during investigation, has been granted anticipatory bail vide Criminal Miscellaneous No.15055 of 2015, after going through

Patna High Court Cr.Misc. No.38531 of 2015 (2) dt.28-09-2015 2/2 the case diary and giving finding that except suspicion, there appears nothing.

Considering the suspicious nature of accusation and coaccused have been granted anticipatory bail vide Criminal Miscellaneous No. 15055 of 2015, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Jamui in connection with Chandradeep P.S. Case No.71 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
