JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-12-2019 This appeal has been filed against the order dated 16.7.2019 passed by learned Additional District Judge-I-cumSpecial Judge, Children Court by which prayer for bail of the appellant was rejected.

Prosecution case, in short, is that while informant was going along with his brother three miscreants came on motorcycle and intercepted him and there is allegation against one Vikash Kumar Singh of firing and brother of informant succumbed to the injuries.

Submission of learned counsel for the appellant is that he has been declared juvenile in conflict with law and there is no allegation of firing against him and he is in remand home since 4.4.2019 and co-accused Manish Kumar Singh has been

Patna High Court CR. APP (SJ) No.3772 of 2019(4) dt.16-12-2019 2/2 granted bail by the then co-ordinate Bench of this Court by order dated 22.1.2019 in Cr.Misc.No. 2765 of 2019 on the same ground.

Heard learned Special P.P. and learned counsel for the informant.

Having heard both sides and in the facts and circumstances, let appellant be released on bail from remand home on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-I-cum-Special Judge (Children Act), Sitamarhi in connection with Mejorganj P. S. Case No. 370 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immovable property within the jurisdiction of court concerned and further condition that he has to co-operate in disposal of trial. Accordingly, the appeal is allowed and the impugned order dated 16.7.2019 is set aside.
