2. The petitioners seek bail in connection with Warisaliganj P.S. Case No. 336 of 2025 dated 24.06.2025 instituted for the offence punishable under Sections 319(2), 318(4), 338, 336(3), 340(2), 61(2), 114(4), 3(5) of Bhartiya Nyaya Sanhita and Sections 66B and 66D of the I.T. Act.

The prosecution case, in short, is that on the alleged date of occurrence the police got secret information that some miscreants indulged in cyber crime have assembled near Baghi field and are cheating innocent people through mobile phones. Thereafter, police raided the said place. Then on seeing police,

It is alleged that two mobile phones have been recovered from the possession of the petitioner no. 1 while from the possession of petitioner no. 2, one mobile phone has been recovered.

4. Learned counsel for the petitioners submits that the petitioners are innocent and they have been falsely implicated in this case. Learned counsel for the petitioners submits that two mobile phones have been recovered from the possession of petitioner no. 1 out of which one mobile belongs to him. One mobile phone has been recovered from the possession of petitioner no. 2. It is further submitted that the petitioners have been arrested at the spot due to suspicion. It is further submitted that co-accused Sudhanshu Patel, was also arrested on the spot, and from whose possession, one mobile phone was recovered, has been granted bail vide order dated 25.08.2025 passed by coordinate Bench of this Court in Criminal Miscellaneous No. 60062 of 2025. It is further submitted that no material with regard to cyber crime has come against the petitioners during investigation. Lastly, it has been submitted that the petitioner is in custody since 25.06.2025 having no criminal antecedents. Charge-sheet has been submitted in the case.

5. Learned A.P.P. for the State opposed the prayer for bail of the petitioners.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioners be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-IV, Nawada in connection with Varishaliganj P.S. Case No. 336 of 2025.
