The petitioner seeks bail in Naya Ramnagar P.S. Case No. 172 of 2016, registered for the offences punishable under Sections 25(1-A), 25(1-B)a, 26 (ii) of the Arms Act. The petitioner started fleeing away after seeing the police and on chase the petitioner was apprehended. On search two country made pistols were recovered from the room of the petitioner.
Learned counsel for the petitioner submits that the recovery cannot be said to be from the conscious possession of the petitioner but it appears that two country made pistols were recovered from the house of the petitioner and the petitioner is accused in Naya Ramnagar P.S. Case No. 110 of 2016, registered
Patna High Court Cr.Misc. No.11644 of 2017 (3) dt.10-04-2017 2/2 under different Sections of the Arms Act.
Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on bail. Accordingly, the same is rejected.
The petitioner may renew his prayer for bail after remaining nine months in custody.
