JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-09-2019 This application, for grant of anticipatory bail, arises out of Shakurabad P.S. Case No. 107 of 2019, disclosing offences under Sections 341, 323, 379, 354, 308, 504 and 506/34 of the Indian Penal Code.

Allegation against petitioner no. 1 is of assault to the informant on his head and when his mother and wife came to save him, petitioner nos. 2 and 3 assaulted them. Submission of learned counsel for the petitioners is that there is case and counter case between the parties and although there is allegation of assault, however, the injuries sustained by the informant and others were found simple in

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jehanabad, in connection with Shakurabad P.S. Case No. 107 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
