The petitioners apprehend their arrest in Sitamarhi P.S. Case No. 305/2014, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code. The FIR is lodged against unknown after recovery of the dead body of a female after two days of the occurrence. The brother-in-law and sister of the deceased identified the dead body of the deceased Nushrat Khatoon. The brother-in-law and sister of the deceased disclosed that the petitioners had come to enquire the whereabouts of the deceased and the brother-in-law and sister of the deceased said that she had gone to Pupri market for purchasing some articles.

Patna High Court Cr.Misc. No.40593 of 2015 (3) dt.09-11-2015 2/2 It is submitted that there is absolutely no evidence to show the involvement of the petitioners. The petitioners were not seen with the deceased.

Learned Additional P.P. did not dispute the fact. Taking into consideration that save and except the fact that the petitioners had gone to enquire the whereabouts of the deceased, there appears no material against the petitioners, the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 305/2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
