The Petitioner seeks bail in Bettiah Town P.S. Case No. 112 of 2016 instituted for the offence under Section(s) 379, 411, 34 of the Indian Penal Code.
From the written report, it appears that this petitioner was apprehended and two persons managed to run away. The informant has alleged in the written report that battery, jack etc have been stolen from his garage.
From the written report itself, there is no mention that any recovery has been made from the possession of this petitioner.
Patna High Court Cr.Misc. No.8165 of 2017 (2) dt.09-03-2017 2/2 In the order of learned Sessions Judge also, it appears that trial has not even begun till date. The petitioner is said to be in custody since 01.03.2016.
In the facts and circumstances of the case, the prayer of the petitioner for bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned IVth Additional Chief Judicial Magistrate, West Champaran in connection with Trial No. 2840 of 2016, arising out of Bettiah Town P.S. Case No. 112 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
