2. The petitioner has preferred this application for grant of regular bail in connection with S.T. No. 289 of 2023 arising out of Katihar Sahayak P.S. Case No. 65 of 2023 dated 25.01.2023 registered for the offences punishable u/s 304B read with 34 of the Indian Penal Code and Section 3/ 4 of the D.P. Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have killed the daughter of the informant due to non-fulfillment of demand of dowry.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner neither demanded any dowry nor

Patna High Court CR. MISC. No.64817 of 2023(2) dt.12-10-2023 2/2 tortured the daughter of the informant. The petitioner is brotherin-law of the deceased. There is general and omnibus allegation against the petitioner. The petitioner has clean antecedent as stated in para 3 of the bail petition. Learned counsel further submitted that the learned court below has not mentioned the date of custody in the impugned order.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the learned counsel for the petitioner has not mentioned the date of custody in the bail petition.

6. Considering the aforesaid facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Katihar in connection with S.T. No. 289 of 2023 arising out of Katihar Sahayak P.S. Case No. 65 of 2023.

7. The application stands allowed.
