Heard Mr. Surendra Kishore Thakur, learned counsel for the petitioner and Mr. Ram Priya Sharan Singh, learned counsel for the State. This is an application seeking quashing of the F.I.R of Gaya Kotwali P.S. Case No. 64/2012 dated 21.02.2012, Corresponding to Trial No. 2105/2013, instituted for the offence under Sections 419, 420 and 34 of the Indian Penal Code and Sections 18 (c), 18(a)(vi) and 27(b)(ii) of Drugs and Cosmetics Rule, 1945.
A report was called for from the court below about the stage of the case on 28.03.2018, which report has since been received. From the report, which is dated 17.05.2018, it appears that after submission of chargesheet, cognizance in this case has been taken under various sections of Indian Penal Code and of the Drugs and Cosmetics Act. Charges also appear to have been framed against all accused persons. In that view of the matter, this petition has become infructuous. This petition stands dismissed as having become infructuous.
