This is a petition for grant of regular bail for offences under Sections 395 and 397 of the Indian Penal Code.

Five miscreants snatched the bag of the informant containing money. While the miscreants were fleeing, the informant raised alarm and the villagers and police came, two persons, i.e., the petitioners, were apprehended at some distance. However, nothing was recovered from the possession of the petitioners.

Submission of the petitioners is that only on suspicion, the petitioners have been apprehended. If they would have snatched the bag, the same must have been recovered instantly. The petitioners have not been put on test identification parade. For recovery of fire arm

Patna High Court Cr.Misc. No.10384 of 2017 (3) dt.12-04-2017 2/2 from the possession of petitioner no. 1, Ibran Alam, a separate case has been lodged.

Considering the aforesaid fact, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) each with two sureties of the like amount each in connection with Balthar P.S. Case No. 78 of 2016 to the satisfaction of the Judicial Magistrate, 1st Class, West Champaran at Bettiah, or successor Court.
