The petitioner seeks bail in Deo P.S. Case No. 43/2016, registered for the offences punishable under Sections 406, 409, 420 and 34 of the Indian Penal Code.

The petitioner took Rs. 10,00,000/- for construction of school building, but the petitioner constructed the building worth Rs. 1,87,000/- within time, thereafter the case was lodged. Learned counsel for the petitioner submits that the petitioner has already completed the entire construction work of the school building and vide annexure-2 the District Programme Officer, Aurangabad found that besides Rs. 1,87,000/-, the petitioner also completed construction work of worth Rs.

Patna High Court Cr.Misc. No.12441 of 2017 (2) dt.22-03-2017 6,35,000/- till 28.02.2017. The petitioner is in jail for last three months.

Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Deo P.S.
