The petitioner seeks bail in Jamalpur P.S. case No. 123 of 2016 under Section 392 of the Indian Penal Code. The informant alleged that petitioner came on a motor cycle along with another accused and snatched a bag containing money from the informant but the petitioner fell down from the bike and another accused fled away. The petitioner was apprehended on the spot.
The learned counsel for the petitioner submits that petitioner could not be able to snatch the bag and only attempt was made and for that the petitioner is in jail since 22.09.2016. The
Patna High Court Cr.Misc. No.14460 of 2017 (5) dt.18-05-2017 2/2 petitioner has already remained in jail for about eight months and only one criminal case is pending against him. Considering the fact that petitioner has already remained in jail for about eight months for making attempt to commit robbery, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-II, Munger in Jamalpur P.S.
