JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 03-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 147, 148, 149, 353, 337, 338, 435, 379, 427 of the Indian Penal Code, Sections 150, 153, 74(A) of the Railways Act and Section 3/ 4 of the Prevention of Damage to Public Properties Act.
It is a case of damaging the public properties in protest relating to Agnipath Sena Bahali.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.59539 of 2022(2) dt.03-02-2023 2/2 petitioner that petitioner is innocent and he has falsely been implicated in this case. The F.I.R is against 7001000 persons. The petitioner was not apprehended from the spot nor anything has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. The petitioner is languishing in custody since 14.07.2022. Considering the nature of accusation and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Railway Magistrate, West Champaran at Bettiah in connection with Sugauli Rail P.S. Case No. 32 of 2022.
