JUSTICE SATYAVRAT VERMA ORAL ORDER 06-05-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411 and 414 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is in custody since 17.06.2021, charge-sheet has been submitted in the case, has antecedent of two cases and the informant alleges that one unknown criminal snatched his mobile on train but was caught with two mobiles and the informant recovered his mobile and the apprehended person disclosed his name as the petitioner.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in the present case, the

No.71193 of 2021(2) dt.06-05-2022 2/2 alleged recovery was made by the informant and not before the police and the seizure list was also prepared at a place different from the place of occurrence as would manifest from perusal of the seizure list i.e. at Patliputra Station.

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 17.06.2021, charge-sheet has been submitted in the case and taking into consideration the submissions made by the learned counsel for the petitioner, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Khagaria Rail P.S. Case No. 14 of 2021.
