JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in S.T. No. 411 of 2005, arising out of Lakhisarai P.S. Case No. 182 of 2003 instituted for the offence under Sections 341, 307 and 324/34 of the Indian Penal Code.

It has been submitted that this is a case of misuse of privilege of bail.

The petitioner is in custody since 31.1.2016. From the impugned order, it appears that four witnesses have been examined. The court below has mentioned in the impugned order that the case is likely to be concluded within two months, but the case has not been concluded till date. Considering the aforesaid facts and circumstance, the

Patna High Court Cr.Misc. No.8827 of 2017 (2) dt.18-03-2017 2/2 prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-III, Lakhisarai, in connection with Sessions Trial No. 411 of 2005, arising out of Lakhisarai P.S. Case No. 182 of 2003, subject to the condition that both the bailors will be the close relatives of the petitioner.

The petitioner will remain present on each and every date till disposal of the trial and default on two subsequent dates, will result in cancellation of the bail bond of the petitioner. (Sanjay Priya, J) Ravi/- U T
