JUSTICE SUDHIR SINGH ORAL ORDER 23-10-2019 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners seek bail in a case registered under Sections 341, 323, 504, 307/34 of the Indian Penal Code and later on Section 302 of I.P.C. has been added. Allegation is that the accused persons including the petitioners assaulted the Chandeshwar Chaudhary, his wife Usha Devi amd Munna Bind by heavy wooden sticks causing injuries on their head. As a result of injuries, Chandeshwar Chaudhary died in course of treatment.

It has been submitted on behalf of the petitioners that

Patna High Court CR. MISC. No.57708 of 2019(2) dt.23-10-2019 2/2 the petitioners are in custody since 30.05.2019 and have got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioners. General and omnibus allegation has been made. Neither any specific overt act is alleged against the petitioners nor any specific injury is attributed against the petitioners.

On behalf of the State and learned counsel for the informant, it is submitted that the petitioners are named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Ara in connection with Barhara P.S. case No.139 of 2019.
