For the Petitioner/s : Mr. Mukesh Kumar For the Opposite Party/s : Mr. Damodar Prasad Tiwary ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 29-03-2017 Heard the parties.
This is a case of misuse of privilege of bail for a period of six years and it is not so that the petitioner has surrendered himself in the court below rather he has been arrested by the Police. It further appears from perusal of the impugned order itself that the learned Addl. District & Sessions Judge, Lakhisarai, while passing order in B.P.No.126 of 2017, filed by the petitioner, disposed of the same directing the trial court to conclude the trial within a period of four months.
Considering the above facts and direction as made above, I am not inclined to grant bail to the petitioner, however, the learned trial court is directed to comply above direction of the learned Addl. District and Sessions Judge and try to conclude it within a period as specified.
Accordingly, this application is dismissed.
