JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 23-03-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sadar Saharsa P.S. Case No. 1005 of 2016, registered under Sections 341 and 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the informant, who is also injured, has disclosed the name of two persons but in his re-statement, he added the name of petitioner and one Ashish about making firing at the time of occurrence. Later on, one injured, Bidnanand Kumar, also stated that this petitioner and three others made firing at the mother of informant

Patna High Court Cr.Misc. No.7369 of 2017 (3) dt.23-03-2017 but she did not sustain injury and in that firing he received firearm injury, as detailed in paragraph 49 of the case diary. Moreover, after investigation police submitted charge sheet showing the petitioner innocent. Further submission is that petitioner has no criminal antecedent and is in custody since 17.12.2016. Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa, in connection with Sadar Saharsa P.S.
