JUSTICE SUDHIR SINGH ORAL ORDER 14-10-2015 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 395 of the Indian Penal Code.
Allegation against the petitioner is of committing robbery at Punjab National Bank, Tandwa Branch, along with other accused.
It has been submitted on behalf of the petitioner that he has got no criminal antecedent. He is in custody since 25.6.2015. Charge sheet has been submitted in the case. Petitioner is not named in the F.I.R. There is no recovery of any incriminating articles from possession of the petitioner. He has not been put on T.I.P. The other co-accused has been granted bail vide Cr. Misc. no. 42668 of 2015.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like
Patna High Court Cr.Misc. No.40084 of 2015 (3) dt.14-10-2015 2 / 2 amount each to the satisfaction of learned Chief Judicial Magistrate, Aurangabad, in connection with Tandwa P.S. Case no. 23 of 2015.
