The petitioner seeks bail in connection with Begusarai Muffasil P.S. Case No. 16 of 2017 registered for the offence punishable under Sections 30(a) & 30(b) of Bihar Excise (Amendment) Act, 2016.
On a tip off, the police conducted raid in the house of the petitioner and seized six bottles of Royal Stag Foreign liquor each containing 750 ml., two bottles of Royal Stage Foreign liquor each containing 180 ml., two bottles of godfather ken Beer containing 500 ml..
Learned counsel for the petitioner submits that no incriminating materials were recovered from the conscious
Patna High Court Cr.Misc. No.11766 of 2017 (2) dt.15-03-2017 2/2 possession of the petitioner. There is no substantive evidence to suggest his implication in the present case. The petitioner is in jail custody since 12.01.2017.
Learned APP, on the other hand, opposed the submissions.
Considering the facts and circumstances of the case, the prayer of bail is allowed. The above named petitioner is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai Muffasil P.S. Case No. 16 of 2017.
