Petitioner apprehends her arrest in connection with RC Case No. 04(A) of 2013, corresponding to Trial No. 27 of 2018, registered for the offences punishable under Sections 120B read with Sections 420, 467, 468, 471, 477A of the Indian Penal Code and Sections 13(2) read with Section 13(1)(d) of Prevention of Corruption Act.

Allegation against the petitioner is that she in connivance with the Members of the Appointing Committee got herself appointed as Gramin Dak Sewak on the forged certificate. Submission of learned counsel for the petitioner is that the main accused, i.e., Member of Appointing Committee, has already been exonerated and petitioner has falsely been implicated in this case and moreover the petitioner is a lady and she is ready to abide by any condition imposed on her.

Patna High Court Cr.Misc. No.39439 of 2018 (3) dt.18-07-2018 2/2 Heard learned for the CBI, who has opposed the prayer for anticipatory bail stating that petitioner got herself appointed on forged certificate.

Having heard both sides and in view of the fact that the main accused has been exonerated, let the petitioner, named above, surrender within a period of six weeks from the receipt of this order and her so surrendering she shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge, Muzaffarpur, in connection with RC Case No. 04(A) of 2013, corresponding to Trial No. 27 of 2018, subject to the conditions as laid down under Section 438(2) Cr.P.C. and further condition is that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to appear before the CBI, otherwise her bail bond shall be cancelled.
