Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks bail in Baisi P.S. Case No. 83 of 2016 instituted for the offence under Section 302 of the Indian Penal Code.

It has been submitted that as per the written report there is specific allegation made by the informant of committing murder of her son against Munni Khatoon, who has already been granted bail by a co-ordinate Bench of this Court, vide order dated 16.12.2016 passed in Cr. Misc. No. 43466 of 2016. From the

Patna High Court Cr.Misc. No.19030 of 2017 (2) dt.28-04-2017 2/2 written report itself it appears that this petitioner (husband of the informant) had gone out for livelihood about 2 days prior to the occurrence.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District & Sessions Judge-V, Purnea in connection with Baisi P.S. Case No. 83 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner.
