2. In the present case, the petitioner seeks bail in connection with Sessions Trial No. 324 of 2025 arising out of Supplementary Baisi P.S. Case No. 288 of 2023, registered for the offences under Sections 143, 341, 323, 354(B), 504, 506 and 34 of the Indian Penal Code. Later on Section 307 and 302 of the Indian Penal Code.

3. As per the prosecution case, petitioner and other coaccused persons assaulted the informant and she received a bleeding injury on her head. Subsequently, she succumbed to her injuries.

4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been

From the FIR it is apparent that some hot talk took place between two sides and specific allegation of assault by a bamboo is against Kachalu Roy@ Kachalu who hit the informant on her head. There is no specific allegation against this petitioner. The petitioner is made accused in this case only for the fact that she is wife of co-accused Kachalu Roy and there is no specific allegation against her for commission of any overt act. The petitioner is in custody since 26.03.2025 and she has no criminal antecedent. Charge sheet has been submitted.

5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the fact that petitioner is a lady and there is no specific allegation of any overt act against her and further considering submission of charge sheet and period of custody, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned 2nd District and Additional Sessions Judge, Purnea/concerned court, in connection with Sessions Trial No. 324 of 2025 arising out of

Patna High Court CR. MISC. No.62019 of 2025(2) dt.10-09-2025 3/3 Supplementary Baisi P.S. Case No. 288 of 2023, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions:

(i) One of the bailors will be a close relative of the petitioner.

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.

(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
