This is a petition for grant of regular bail for offence under Section 392 of the Indian Penal Code.
The first information report with allegation of road robbery is against unknown person. The petitioner was remanded in this case, on 28.05.2016, without collection of any evidence, from another case. Submission is that thereafter there is no test identification parade of the petitioner and in a perfunctory manner only on the basis of criminal record of the petitioner he has been remanded in this case and nothing has been recovered from the possession of the petitioner.
Hence, having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Bochohan P.S. Case No. 247 of 2014 to the satisfaction of the Additional Chief Judicial Magistrate-cum-Sub Judge, XI, Muzaffarpur, or successor Court with the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the Court below shall cancel the bail bond of the petitioner.
