JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 As prayed for learned counsel for the petitioners is permitted to make necessary correction in the petition with regard to village of the petitioners.

This application, for grant of anticipatory bail, arises out of Kawakole (Rupau) P.S. Case No. 157/2019, disclosing offences under Sections 147, 149, 341, 323, 307, 353, 337, 338, 427, 186, 226, 504 and 506 of the Indian Penal Code. Prosecution case is that police on information that some occurrence took place at village Nawadih and some persons have received injury, went there and arrested one Mithilesh Yadav but in the meantime several accused persons assembled including petitioners and attacked the police party, in

Patna High Court CR. MISC. No.59443 of 2019(2) dt.19-09-2019 2/2 which, some of the constables have received injuries also. Submission of learned counsel for the petitioners is that they have falsely been implicated in this case and they are villagers and no specific allegation has been attributed to them rather main allegation is against one Mithilesh Yadav.. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, let petitioners, above named, surrender in the court below within two weeks from the date of receipt of the order, on which, they are directed to be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Nawada in connection with Kawakole (Rupau) P.S. Case No. 157/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

This is further subject to the condition that they will cooperate in investigation of the case and will appear as and when required by the police.
