JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-09-2019 This is an application for grant of anticipatory bail in connection with Araria P. S. Case No. 445 of 2019, disclosing offences under Sections 147, 149, 341, 323, 324, 307, 379, 354, 448, 504 and 506 of IPC.
As per F.I.R. there is general allegation against these
Patna High Court CR. MISC. No.61033 of 2019(2) dt.25-09-2019 2/3 petitioners is of assaulting the informant and his family members.
Submission of the learned counsel for the petitioners is that specific allegation is against one Nooruddin and Naushad. No specific allegation has been attributed against these petitioners. The scuffle took place with respect to dispute between the children of the parties. There is case and counter case between the parties and now compromise has been reached between the parties.
Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Araria, in connection with Araria P.
