The petitioner seeks bail in connection with Rahui (Bhagan Bigha) P.S. Case No. 309 of 2016, registered under Section 379 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that in course of investigation Shyamdeo Kumar and Dhirendra Kumar @ Fantus were apprehended by the Police and they confessed their guilt regarding theft of motorcycle by them and his other associates and also about getting the motorcycle at the house of the petitioner. Thereafter, the stolen motorcycle was recovered from the verandah of house of the petitioner. Further submission is that, in fact, Shyamdeo Kumar and Dhirendra Kumar kept the

No.15023 of 2017 (2) dt.13-04-2017 2/2 motorcycle at the verandah of the petitioner saying that they will take the motorcycle after three days, but in the meantime, the Police seized the motorcycle from the verandah of the petitioner. The petitioner has no criminal antecedent is in custody since 22.12.2016.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the ACJM-II, Nalanda in connection with Rahui (Bhagan Bigha) P.S. Case No. 309 of 2016.
