JUSTICE MOHIT KUMAR SHAH ORAL ORDER 13-09-2018 After some argument the learned senior counsel appearing for the petitioner seeks to withdraw the present writ petition with liberty to file an appeal under Clause 32 of the Bihar Targeted Public Distribution System (Control) Order, 2016. Accordingly, the present writ petition is disposed of as withdrawn with liberty to the petitioner to file an appeal. It is needless to state that the Appellate Authority shall consider the factum that the petitioner had defaulted in depositing the renewal license fee on account of death of his wife. It is further directed that in case the petitioner files an appeal within a period of four weeks from today, the Appellate Authority shall hear the appeal of the petitioner on merits and shall not be impeded by the issue of limitation.
