2. The petitioners apprehend their arrest in Kotwa P.S. Case No. 102 of 2023 registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, pending in the Court of learned Exclusive Special Excise Court No. 1, Motihari, East Champaran.

3. After some arguments, learned counsel for the petitioners seeks permission to withdraw this application.

4. Permission is granted.

5. Accordingly, the instant application is dismissed

Patna High Court CR. MISC. No.63669 of 2023(3) dt.19-01-2024 2/2 as withdrawn. However, if the petitioners surrender before the learned Court below within a period of six weeks from today and seeks regular bail, the learned Court below would pass the order, preferably, on the same day, without being prejudiced by this order.
