The petitioner seeks bail in a case registered under Sections 147, 149, 341, 323, 307, 353, 337, 338, 427, 186, 226, 504, 506 of the Indian Penal Code.

Allegation is that the accused persons including the petitioner along with 40-50 unknown persons armed with lathi, danda, bricks came and assaulted the informant and other police personnels, due to which they sustained injuries. It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.6.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The nature of injury is said to be simple.

Patna High Court CR. MISC. No.58205 of 2019(2) dt.17-09-2019 2/2 Hence, no offence under Section 307 of the I.P.C. is made out. Other co-accused have been granted bail vide Cr.Misc.No.53682 of 2019.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st, Nawada in connection with Kawakole P.S. case No.157 of 2019.
