The petitioner claims that his father is missing for which a first information report has already been lodged with allegation that his father was living with Gurdya Devi for the last 2 - 3 years and she has got the property registered in her name also. It is submitted on behalf of the State that the police is investigating the matter.
Patna High Court Cr. WJC No.1083 of 2018 dt.06-07-2018 2/2 Accordingly, this writ petition is disposed of in terms of law laid down by the Hon'ble Supreme Court in Sakiri Vasu Versus State of Uttar Pradesh and others [(2008) 2 Supreme Court Cases 409 and again affirmed in Sudhir Bhaskarrao Tambe Versus Hemant Yashwant Dhage and others [(2016) 6 Supreme Court Cases 277].
If the petitioner is aggrieved that proper investigation is not being done then, in terms of the aforesaid decisions of the Hon'ble Supreme Court, he would be at liberty to move before the court concerned.
However, at the same time, the police would be required to investigate the matter and find out the truth expeditiously.
