The petitioner seeks bail in connection with Bounsi P.S. Case No. 144 of 2021 giving rise to Special Case No. 505 of 2021 instituted for the offences under Sections 30(a), 32(2) and 34 of the Excise Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 09.07.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Learned counsel for the petitioner submits that the allegation is of recovery of 448.56 litres of liquor from a pickup van and the petitioner is alleged to have been arrested along with two named accused persons.

Learned counsel for the petitioner submits that the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 09.07.2021, charge-sheet has been submitted in the case and the petitioner is neither the owner nor the driver of the said vehicle, let the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Banka in connection with Bounsi P.S. Case No. 144 of 2021.
