2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Sections 457 and 380 of the Indian Penal Code, registered in connection with Balia Belon P.S. Case No. 122 of 2023.

3. As per prosecution case, some unknown thieves have committed theft in the house of the informant and taken away jewellary and other articles.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner is not named in the FIR rather the same has been lodged against unknown person. On the basis

Patna High Court CR. MISC. No.63003 of 2024(2) dt.11-09-2024 2/2 of suspicion and due to his criminal antecedents, he has been made accused in this case. No incriminating article has been recovered from the conscious possession of the petitioner and he is in custody since 08.02.2024.

5. Learned APP for the State has opposed the prayer of bail.

Considering the above facts and circumstances of the case, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Chief Judicial Magistrate, Katihar in connection with Baliya Belon P.S. Case No. 122 of 2023, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
