JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

Petitioner seeks bail in connection with Sheikhopur Sarai P.S. Case No. 94 of 2016 registered for the offences punishable under Sections 341, 323, 337, 504 and 302/34 of the Indian Penal Code.

Allegedly, the petitioner and her husband started assaulting Nagendra Pandey, the father of the informant, with bricks causing injury to him and further assaulted the informant also causing injury to him, the father of the informant died later on when he was being brought for treatment at Barbigha.

Submission is of false implication and that no external injury has been found on the person of the deceased, the father of the informant died due to brain hemorrhage and cardiac arrest. The doctor who has conducted the post mortem examination has

Patna High Court Cr.Misc. No.6355 of 2017 (2) dt.18-03-2017 found the cause of death internal hemorrhage and cardiac arrest. The petitioner is a lady and she is suffering in custody since 20.10.2016 with her minor child.

Learned APP opposes the prayer of bail.

In the facts and circumstances stated above, considering the gender of the petitioner, the petitioner above named is directed to be released on bail on execution of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Ist, Sheikhpura in connection with Shekhopur Sarai P.S. Case No. 94 of 2016, subject to the conditions that one of the bailors must be a near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on her part without any reason shall disentitle the petitioner from privilege of bail.
