This application for anticipatory bail arises out of Asthawan P.S. Case No. 133 of 2019, disclosing the offence under Section 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act.

Considering the fact that petitioner has criminal antecedent, as can be noticed from paragraph-3 of the application, I am not inclined to grant the petitioner privilege of anticipatory bail.

This application is accordingly rejected.

However, the petitioner is directed to surrender before the Court below within four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail

Patna High Court CR. MISC. No.56722 of 2019(2) dt.06-09-2019 2/2 shall be considered on its own merit without being prejudiced by rejection of the present application for grant of anticipatory bail by this Court.
