JUSTICE ARVIND SRIVASTAVA ORAL ORDER 03-01-2023 Heard learned counsel for the petitioner, learned A.P.P. for the State and learned counsel for the Informant. The petitioner apprehends his arrest in connection with Bela P.S. Case No. 18 of 2022 registered under Sections 363, 366(A) read with Section 34 of the Indian Penal Code, 1860 and Section 8 of the POCSO Act.
Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to misrepresentation and mistake of facts. Further submission is that victim in her statement under Section 164 of Cr.P.C. stated that she willingly solemnized marriage with the petitioner and desires to stay at her matrimonial home. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional Sessions Judge-VIcum-Special Judge (POCSO Act), Sitamarhi in connection with Bela P.S. Case No. 18 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
