JUSTICE SANJAY PRIYA ORAL ORDER 18-03-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Rampur P.S. Case No. 205 of 2016 (G.R. No. 3930 of 2016) instituted for the offence under Section 379 of the Indian Penal Code.
It has been submitted that the petitioner is in custody since 5.9.2016 and he has no criminal antecedent. He has been arrested by the police on suspicion. Police got his confessional statement recorded. He is not named in the written report. It is stated that some unknown persons snatched the golden chain of the informant worth Rs.60,000/-. The petitioner has not been put on Test Identification Parade.
From the impugned order it appears that there is no recovery of any incriminating article from the possession of the
Patna High Court Cr.Misc. No.11098 of 2017 (2) dt.18-03-2017 2/2 petitioner.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Miss Swati Singh, learned Judicial Magistrate IInd Class, Gaya, in connection with Rampur P.S. Case No. 205 of 2016, G.R. No. 3930 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
