====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 15-09-2017 This application has been filed for recall of the order dated 22.06.2011 passed by a Bench of this Court in C.W.J.C. No. 13551 of 2002.
It is indicated in the application that the writ petition has been disposed of on merit without granting hearing to the petitioner and therefore, the order is sought to be recalled. A perusal of the order passed on 09.09.2011 goes to show that petitioner was represented by the counsel, the State was represented by the counsel and after hearing all concerned, detail order was passed. Except for contending that in the absence of petitioner's counsel, the matter was heard, there is nothing on record, based on which the order can be recalled. The application has not been filed for revision of the order but for recall of the order passed on 22.06.2011. However, after the order was passed on 22.06.2011, the records
Patna High Court MJC No.2555 of 2011 (2) dt.15-09-2017 2/2 indicate that the writ petition itself was heard in detail and thereafter decided on 09.09.2011 and once the writ petition itself has been decided on 09.09.2011 after the order in question was passed on 22.06.2011, no case is made out for modification of the order dated 22.06.2011. The petitioner is required to challenge the order dated 09.09.2011, in case he has any grievance in the matter. With the aforesaid, finding no case for modification or recall of the order, the application stands dismissed.
