In this case, petitioners are seeking anticipatory bail in connection with Sahebpur Kamal P.S. Case No. 196 of 2014 registered for offence under section 7 of the Essential Commodities Act.
On information received from the Ex-Mukhiya and others, the Police had gone to Rasalpur and 44 bags of rice were handed over to the Police. It has been stated that the Tractor Driver fled away. It was found that aforesaid rice meant for the Public Distribution System run by two persons, namely, Krishna Menon and Sikandar Prasad was being sent for black marketing.

No.42114 of 2014 (2) dt.20-03-2015 2/2 The counsel for the petitioners submits that the aforesaid rice was not recovered from the place of the petitioners and stock register shows the rice as nil and, as such, only on account of the statement of Ex-Mukhiya, the petitioners cannot be refused anticipatory bail. Seizure list does not bear signature of the petitioners, as it appears from the first information report that the rice was taken by the Driver on a Tractor Trolley. The submission advanced by the petitioners does not attract to this Court. Accordingly, this petition is rejected. (Shivaji Pandey, J) Mahesh/- U T
