The Petitioner seeks bail in Adapur P.S. Case No. 93 of 2016 instituted for the offence under Section(s) 272, 273 Indian Penal Code and Section 47(a) of the Bihar Excise Act, 2016. It is alleged that total 8 Liter 700 Milliliter Nepali Safi liquor was recovered from the possession of the petitioner. Seizure memo has been enclosed with the First Information Report, which does not bear the signature of the petitioner. It has been submitted that the petitioner is aged about 60 years having clean antecedents. The petitioner is in custody since 02.07.2016.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner,

Patna High Court Cr.Misc. No.7296 of 2017 (2) dt.02-03-2017 2/2 above named, be released on bail on furnishing bail bond of `10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A. Mishra, Judicial Magistrate, Raxaul, Motihari, East Chamapran, in connection with Adapur P.S.
