2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 392 & 411 of the Indian Penal Code.

3. According to the FIR, some miscreants including the petitioner are alleged to have intercepted the informant and snatched his motorcycle bearing Reg. no. BR02BG3885 along with mobile, Driving license and other articles.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He is not named in the FIR. He has falsely been made an accused in the present case on the basis of secret information. Only a pithu bag

Patna High Court CR. MISC. No.63911 of 2023(2) dt.11-10-2023 2/2 is said to have been recovered from possession of the petitioner. Except this, nothing consistent material came against the petitioner during investigation. He has also not been put on TI Parade. It is further submitted that the petitioner is languishing in judicial custody since 20.5.2023.

5. Learned APP appearing for the state has opposed the prayer of regular bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody period of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Islampur P.S. Case No. 241 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda.
