2. The petitioner apprehends his arrest in a case registered for the offence under Sections 30(a), 32(i)(ii), 36, 41(i)(ii) of Bihar Prohibition and Excise Act.

3. As per F.I.R., 682.560 liters of illicit foreign liquor has been recovered from a pick-up van.

4. It is submitted on behalf of petitioner that petitioner is neither owner nor driver of the vehicle in question and no incriminating article has been recovered from his possession. Petitioner claims clean antecedent.

5. Considering the nature of allegation and clean antecedent of petitioner, let the above named petitioner, in the event of his arrest or surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs.

Patna High Court CR. MISC. No.61567 of 2023(2) dt.16-10-2023 2/2 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge Excise Court No. II, Muzaffarpur in connection with Kanti P.S. Case No. 584 of 2023, subject to conditions as laid down under Section 438(2) of the Cr.P.C.
