Petitioner is in custody since 08.10.2016 in connection with Bachhwara P.S. Case No. 128 of 2016 registered under Sections 414 of the Indian Penal Code.

Learned counsel for the petitioner has submitted that the petitioner is innocent and has not committed any offence. No recovery has been made from the conscious possession of the petitioner rather the Passion Pro Motorcycle bearing Registration No. BR-09-3614 has been recovered from back side of the house of the petitioner. In fact, the owner of the said motorcycle has not lodged any case with regard to seized motorcycle, which is evident from paragraph-9 of this petition.
