2. The petitioners have preferred this application for grant of regular bail in connection with Korma P.S. Case No. 24 of 2025 dated 06.03.2025 registered for the offences punishable u/ss 126(2), 115(2), 117(2), 303(2), 352, 351(2) read with Section 3(5) of the B.N.S.

As per the prosecution case, on 05.03.2025, when the informant was returning from Sheikhpura to his home Murarpur with medicines for his mother and reached near Primary School, Murarpur where accused persons namely, Ghanshyam Ram, Rohit Ram and Dis Ram were already waiting there. The petitioner Ghanshyam Ram fired four rounds on the informant with the

No.59553 of 2025(2) dt.02-09-2025 2/3 intention to kill him but the bullet passed closely to his ear and when he started running for his life, the accused persons abused him and chased him and they altogether slammed the informant on the ground and the petitioner Ghanshyam Ram and the co-accused Dis Ram assaulted him with an iron rod on his head and the petitioner, Rohit Ram assaulted with brick on his right hand. It is further alleged that the petitioner, Ghanshyam Ram snatched a golden Bajrangbali locket from the informant and also abused and assaulted him. When the informant protested, the petitioner, Ghanshyam Ram threatened him on the gun point and told him that he would be killed if he would lodge a case against them. Thereafter, the accused persons fled away from the spot and then the injured was taken to the hospital for treatment.

4. Learned counsel for the petitioners has submitted that the petitioners are innocent and have falsely been implicated in this case. There is case and counter case between the parties. There is general and omnibus allegation against the petitioners. Nothing has been recovered from the conscious possession of the petitioners. As per the impugned order, the injury of the informant is simple in nature caused by hard and blunt substance. The petitioner no. 1 has thirty criminal antecedents whereas the petitioner no. 2 is concerned, he has ten criminal antecedents and both the petitioners are on bail in the aforesaid cases as stated in

Patna High Court CR. MISC. No.59553 of 2025(2) dt.02-09-2025 3/3 para 3 of the bail petition. The petitioners are in custody since 30.05.2025.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioners.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioners abovenamed, are directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Court concerned, Sheikhpura in connection with Korma P.S. Case No. 24 of 2025, with the conditions :- (i) The petitioners are directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioners are liable to be cancelled. (ii) If the petitioners are found involved in similar nature of offence in future, the prosecution will be at liberty to move for cancellation of his bail bonds.
