JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 03-04-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Sherghati P.S. Case No. 532 of 2016, registered for the offences punishable under Sections 420, 409/34of the Indian Penal Code.

Allegedly, the petitioner and co-accused misappropriated government amount total Rs. 2907082/- as they have purchased paddy from farmers, but did not deposit rice in B.S.F.C.

Submission is of false implication and that there is allegation against the petitioner and PACS Chairman for misappropriating the government amount of Rs. 2907082/- and in view of the recent decision of Hon'ble Apex Court the petitioner is

Patna High Court Cr.Misc. No.7169 of 2017 (3) dt.03-04-2017 2/2 ready to give bank guarantee of Rs. 15 lakhs. The learned A.P.P. fairly submits that in case the petitioner gives bank guarantee of Rs. 15 lakhs, lenient view can be taken.

In the facts and circumstances as stated above, if the petitioner gives bank guarantee of Rs. 15 lakhs in favour of Magadh Central Co-operative Bank, Branch- Sherghati, then in the event of his arrest or surrender within eight weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Sherghati (Gaya), in connection with Sherghati P.S. Case No. 532 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
